1. Acceptance of Terms
By accessing or using Tracia Labs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by Tracia Creative ("we", "us", "our").
2. Description of Service
Tracia Labs is an AI-powered tool that generates Etsy listings, Pinterest content, SEO metadata, mockup prompts, social media copy, and event wording based on product images you upload. Output is provided "as-is" for your review and editing before publication.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to use the Service.
4. Subscription & Billing
Paid plans are billed monthly in advance via Stripe. You may cancel anytime from your billing page; cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months except as described in our Refund Policy.
5. Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes: attempting to bypass usage limits, reverse-engineering the platform, uploading content that infringes third-party rights, generating listings for illegal products, or using automated scripts to access the Service.
6. Intellectual Property
You retain all rights to the product images you upload and the listings you create. Tracia Creative retains ownership of the Service, its software, and underlying technology. We do not claim ownership of your generated content.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind. AI-generated content may contain inaccuracies. You are responsible for reviewing all output before publishing to Etsy or any other platform.
8. Limitation of Liability
To the maximum extent permitted by law, Tracia Creative shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use after changes constitutes acceptance.
